General Business Terms and Conditions

§1 Business Objective:

Vienna Classic sells and/or arranges for admission tickets of various event holders. In this, Vienna Classic assumes for its customers the booking and procurement of admission tickets, as well as their delivery or safekeeping ready for pick-up.

§2 Concluding Contracts:

The data and information concerning all of the events listed by Vienna Classic have been painstakingly researched, and are updated regularly. No warranty can be assumed, however, for the completeness, accuracy and currency of the details stated.
What is intended by the information and data concerning the individual events announced by Vienna Classic are non-binding quotations, meaning that no contract comes into being yet upon a booking request from the customer. A contract only comes into being once the charge of the remuneration by the credit-card company and/or bank cited upon ordering has been authorized, and Vienna Classic has confirmed the booking (via e-mail).
Upon an order through the Internet, completion of the following steps consequently leads to conclusion of a contract:

• Selection of the performance, number of tickets and category;
• Selection of the type of pick-up or delivery;
• Statement of personal data, selection of payment mode and consent to these General Business Terms and Conditions;
• Verification summary of all of the data and transmission of the order;
• The receipt of your order will be confirmed directly after your order is sent off and such confirmation does not yet represent a binding acceptance of your agreement;
• A binding confirmation of the order shall be sent by Vienna Classic. This confirmation will be provided within three working days of your placing the order and represents the conclusion of the agreement.

§3 Prices:

All of the prices are intended as including any applicable taxes and fees, yet excluding shipping expenses, which vary according to the type of delivery selected by the customer.

 

The statutory sales tax for theaters and events is 13%. The following organizers are allowed to sell tickets at a reduced tax rate of 10%: State Opera, Volksoper, Burgtheater, Akademietheater, Musikverein, Konzerthaus, Seefestspiele Mörbisch, Volkstheater, Salzburg Festival

For events that include a dinner, the dinner portion is taxed at 10% and the concert portion at 13%.

 

Our prices include different service and processing fees, these are divided into 4 price classes:

 

• Price class  A: 0% surcharge, which means the final price is identical to the original price

• Price class B: is sold with a service and processing fee of 26% of the original ticket price, this is already included in the final price shown

• Price class C: is sold with a service and processing fee of 52% of the original ticket price, which is already included in the final price shown

• Price class D: is sold with a service and processing fee of 100% of the original ticket price, which is already included in the final price shown

 

The service and processing fees are calculated according to the effort involved in processing, procurement and additional financial costs.

Price class A applies to events where Vienna Classic has a commission agreement with the organizers and can therefore pass on the original ticket price.

Price class B applies to the majority of events. Vienna Classic does not receive any commissions here.

Price class C applies to “highlight” events with a limited number of tickets, which are particularly in demand. The effort for processing and procurement is associated with additional financial costs.

Or it affects events that are particularly cheap. Here, Vienna Classic has to charge a higher surcharge to cover the expenses.

Price class D applies to events that are particularly limited and in high demand. Here, too, the acquisition costs for Vienna Classic are higher than the original ticket price shown on the ticket and the purchase is very expensive due to high demand.

 

The customer authorizes Vienna Classic to debit the payment from the specified account or credit card after receipt of the order.

§4 Annulment, Cancellation of Event:

Vienna Classic is not liable for the reimbursement of admission charges for cancelled or rescheduled events, for example. These claims are to be enforced by the customer directly with the holder of the event, such that the terms and conditions announced by the respective holder of the event for ticket return apply. Vienna Classic shall strive to support its customers in the course of enforcing these claims, but it is not obligated to do so. As a rule, tickets can only be redeemed at the cashier counters of the holder of the event and at the price printed on the ticket. In case that reimbursement for the booking and the shipment of the tickets was also included along with the ticket price determined by the holder of the event, any refund of this reimbursement by Vienna Classics shall be excluded.

§ 5 Cancellation Cover Package

The Cancellation Cover Package can only be added to the tickets that are in the shopping cart at the time of the purchase. It is not possible to buy the Cancellation Cover Package after the purchase of the tickets, neither for individual ones. By choosing the Cancellation Cover Package option, the corresponding amount will be added to the price. Cancellation Cover can only be bought for a maximum of 20 tickets.

Vienna Classic will process the full refund of your ticket as part of the Cancellation Cover Package when cancelled prior to 14 days of the event and a refund of 50% prior to 7 days of the event . The date of the postmark applies, however the day of the event is not included.

The cancellation request must be received by registered letter. If the the request is not sent as registered letter, the costumer shall bear the risk and must prove the timely arrival of the form.

The customer has to fill out the Cancellation Cover form (Link) provided by Vienna Classic.In case of postal delivery and office pick-up, the tickets, that wish to be cancelled, must be attached to the form. In case of an incomplete form, Vienna Classic will not be able to proceed with the request for a reimbursement.

After receiving your completely filled out cancellation request on time, you will receive a refund within 14 days, using the same payment method that you originally used.

The cost of the Cancellation Cover Package is 7,5% of the original ticket price rounded up to the next € 0,50.

§6 Events Bookable 1 Month in Advance at the Earliest:

With some holders of events, in particular the Vienna State Opera (Staatsoper), Volksoper, Burgtheater, Akademietheater, Music Society (Musikverein) and Concert House (Konzerthaus), tickets can as a rule only be booked bindingly 1 month prior to the date of performance, at the earliest. In this case, the points-in-time of the charge of the reimbursement and the confirmation of the booking by Vienna Classic are temporally separated, in particular the mere charge of the reimbursement not representing any booking confirmation. Should the event ordered by the customer no longer be bookable, any sum that may already have been charged by Vienna Classic shall be restituted forthwith.

§7 Exclusion of Liability:

Vienna Classic does not bear any liability with respect to the customer for the contents of the events listed. The customer acknowledges that the respective holders of events have as a rule reserved the right to make changes in casting and program. Vienna Classic is in particular also not liable for (frustrated) efforts that the customer has expended arising from any possible cancellation, rescheduling, or program or casting changes, particularly those such as travel and sojourn expenses incurred. The liability of Vienna Classic is in any case limited to at least grossly negligent behavior on the part of its employees.

§8 Right of withdrawal

All tickets sales are fixed orders without the possibility of cancellation.

§9  Applicable Law, Court Venue:

Agreed upon is the application of Austrian Law under exclusion of the conflict rules as well as of the UN Convention on Contracts for the International Sale of Goods. The court having jurisdiction and competence for the 1st Municipal District of Vienna is agreed upon as court venue hereunder.

§10 Payment:

You may choose to pay using your credit card or the automatic debit transfer system. We accept the following credit cards: VISA, MasterCard and Diners Club. Automatic debit transfer system - Payments are currently being accepted via this system for the following countries: Austria, Germany and the Netherlands. Your credit card account or bank account will be charged immediately after your order is completed.

§11 The text of the agreement:

We will save the text of the agreement and send you the purchase order information and our General Terms and Conditions via e-mail. You can view your previous orders in our customer login section. You have the possibility of completing the purchase order in German or English.

§12 Right to cancel (only applicable to vouchers)

You have the right to cancel this contract 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail).

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancel before the cancellation period has expired.

Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

This policy is only applicable to vouchers.
